Artorias, Inc. ("Artorias", "we", "us"), which provides SITREP, respects intellectual property rights and expects SITREP users to do the same. We respond to notices of claimed copyright infringement under the US Digital Millennium Copyright Act (17 U.S.C. 512). Words such as "handle", "SCATTER" and "Community Content" have the meanings given in the SITREP Terms of Service (artorias.com/legal/sitrep/terms).
01Where to send a notice
Send copyright notices and counter-notices to our Copyright Agent:
Copyright Agent, Artorias, Inc.169 Madison Ave, Suite 11590, New York, NY 10016, United StatesEmail: hello@artorias.com, subject "Copyright notice" (or "Copyright counter-notice")Email is the fastest way to reach us.
02What your notice must include
Under 17 U.S.C. 512(c)(3), your notice must include:
- Your physical or electronic signature, or that of the person authorized to act for the copyright owner.
- Identification of the copyrighted work you say is infringed (or, if one notice covers several works, a representative list).
- Identification of the material you say is infringing, with enough information for us to find it. SITREP Community Content is visible only to signed-in users and has no public web address, so please give: the SITREP handle that posted it; where it appeared (the alert headline, the channel name, or the place for an incident report); when (the date and approximate time, with time zone); and a screenshot if you can.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the right that is said to be infringed.
Signed-in users can also flag content with the in-app Report button. A report that does not include the information above is not a copyright notice, but we will still review the content against our rules.
We may not act on a notice that does not substantially meet these requirements. You may be liable for damages, including costs and attorneys' fees, if you knowingly misrepresent that material is infringing (17 U.S.C. 512(f)). Please consider whether the use may be fair use before you send a notice: commentary, criticism and news reporting can be fair use.
03What we do with a valid notice
When we receive a valid notice, we promptly remove or disable access to the material and tell the user who posted it in the app. On request, we give that user a copy of the notice, with the sender's personal contact details removed except where they are needed for a counter-notice.
04Counter-notices
If you believe your material was removed by mistake or misidentification, you can send our Copyright Agent a counter-notice. Under 17 U.S.C. 512(g)(3) it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before it was removed (the handle, the place in the app, and the date).
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Artorias may be found), and that you will accept service of process from the person who sent the original notice, or their agent.
We send the counter-notice to the person who sent the original notice. Unless, within 10 business days after we receive the counter-notice, they tell us that they have filed a court action to stop the activity, we restore the material between 10 and 14 business days after we received the counter-notice.
05Repeat infringers
We close, in appropriate circumstances, the accounts of users who repeatedly infringe. As a rule, an account that receives three valid notices within 12 months that are not successfully countered is banned. We may act sooner for flagrant infringement. Restrictions apply to the account, not the handle, so changing handle or using SCATTER does not reset them.
06Other intellectual property complaints
For trademark or other intellectual property complaints, email hello@artorias.com with the subject "Intellectual property complaint".
07Changes
We may update this policy. The current version is always at artorias.com/legal/sitrep/copyright.
